Terms and Conditions

Welcome to the Flying Monkey website. Your purchase of merchandise, gift cards, and e-gift cards is subject to the following terms and conditions ("Sale Terms"). By placing an order through our website, mobile app, or by telephone, you acknowledge and agree to abide by these Sale Terms.

Please be aware that these Sale Terms may undergo periodic changes. We recommend reviewing and saving a copy for your personal reference before each order.

Order and Acceptance

Every order submitted to Flying Monkey constitutes an offer to make a purchase. Upon receiving your order, we will send an email confirming its receipt. However, this confirmation does not constitute acceptance of your order.

Flying Monkey's acceptance becomes final only when the item(s) you requested have been shipped, and you receive a Shipment Confirmation Email. You can track your order's progress on our Track My Order page.

If your order is rejected due to pricing errors or other discrepancies, we will notify you by email. After rectifying the error, you can resubmit your order. You will not be required to pay more than the order total specified in the Shipment Confirmation Email or Ready for Pickup Email.

Should the merchandise received differ from the description on our website at the time of your order, you have the right to request a return or exchange as per our Refund and Return Policy.

While it is unlikely, Flying Monkey reserves the right to decline any order for various reasons, including:

• Error(s) in Billing, Payment, and/or Shipping Information.
• Incorrect credit card or debit card information.
• Billing details inconsistent with your financial institution's records.
• Incomplete or incorrect shipping address.
• Suspected fraudulent information.

Delayed Shipment or Unavailability of Merchandise

If merchandise is delayed, becomes unavailable, or if an error occurs on the website related to your order (e.g., price or description errors), Flying Monkey may cancel the order and notify you accordingly.

Reshipping of Merchandise

Flying Monkey does not permit merchandise to be reshipped, and orders destined for freight forwarding companies are not accepted. Please refer to our Shipping Policy page for a complete list of countries we ship to.

Resale of Merchandise

To protect our intellectual property rights as a private label brand, Flying Monkey strictly prohibits any suspected resale of our merchandise for personal or business profit. We reserve the right to cancel any order involving reselling, and customers suspected of reselling may be denied subsequent orders.

Previous Fraudulent Order History

We may refuse orders in cases of suspected fraudulent activity. Additionally, orders from customers with a history of fraudulent orders or related credit card disputes may be declined.

Engagement with Flying Monkey and Affiliates

The Company (Flying Monkey, Vervet, and Lovervet) reserves the right to block the receipt of marketing communications, remove, and unsubscribe email addresses, phone numbers, or mailing addresses associated with customers displaying characteristics of reselling or placing fraudulent orders. These actions may affect multiple Company platforms, including online accounts, promotional club memberships, email marketing lists, text messaging programs, and direct mailing lists. Affected customers may also be prohibited from accessing or registering for these platforms in the future.

 

Limitation of Liability

Under no circumstances shall FLYING MONKEY or any other party involved in creating or maintaining the site or its contents be held liable for any damages, including but not limited to direct, incidental, special, consequential, indirect, or punitive damages. This also encompasses damages arising from lost profits, lost data, business interruption, or copyright infringement, resulting from your access to or use of the site, including any potential harm to your computer equipment.

 

Disclaimers

1. Information Handling: We hereby disclaim any responsibility for the deletion, failure to store, mis-delivery, or untimely delivery of any information or material, including purchase orders submitted to or transmitted through the Site. We do not warrant that the site will be uninterrupted or error-free.

2. Content and Services: We do not make any warranty as to the content on the site. The site, along with the content and services available, is provided on an "as is, as available" basis. Any material you download or obtain through the site is at your own discretion and risk. You will be solely responsible for any damages to your computer system or loss of data resulting from such downloads.

3. Site Functionality: We make no warranties that the site will meet your requirements, be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy or reliability of the site. Furthermore, we do not assure that the quality of any products, services, information, or other material obtained through the site will meet your expectations. We do not guarantee the site to be free of viruses or other harmful or malicious code, nor do we guarantee that errors on the site will be corrected.

No Express or Implied Warranties: We make no warranties, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. This applies to the site, any content, or any of the services, tools, or products available on the site. You expressly agree to assume the entire risk concerning the quality, performance, accuracy, or completeness of the site and its content.

5. Denim Characteristics: Due to the nature of indigo and other denim dyes, color may transfer onto lighter fabrics and other surfaces. Please avoid contact with light-colored surfaces. Normal fading can occur with wash and wear. Vintage washes are intentionally distressed to appear old and well-worn, and intentional rips and tears may continue to develop over time.
